Delilah Noir "Spring Has Sprung" Customization Contest Official Rules

Contest begins 3/8/2019 at 12:01 AM Central Daylight Time (CDT) and ends 5/1/2010 at 11:59 PM CDT. By submitting an entry, each entrant agrees to the Official Rules and warrants that his or her entry complies with all requirements set out in the Official Rules. This is a skill-based contest, and chance plays no part in the determination of winners.

Who may enter:
U.S. Residents ages 18 and over - except for individuals affiliated with The Bradford Group or Ashton-Drake Galleries, including but not limited to past or present employees, consultants, vendors, and their immediate families (children, siblings and spouses) and others living in their households - are eligible. Ashton-Drake will determine winners' eligibility.

What to enter:
To enter, email ‘materials’ (photographs and other required information) to media@delilahnoir.com by 11:59pm CDT on May 1, 2010. A valid entry consists of Digital images of a single doll (maximum of 3), Name, Address, Email, Phone Number, Entry Title, Entry Description/Story. We do not accept entries submitted through the mail. Submit no more than three (3) photographs per entry or entry will not be considered valid. Only one entry is allowed per person.

Digital photographs or renderings and high-quality scans of non-digital photographs, sketches, drawings, or paintings ("Images") are acceptable for entry. Files must be in .jpeg, .jpg or .gif formats. Files submitted may not be larger than 2,048k (2Mb).

By entering the Contest, entrant represents, acknowledges, and warrants that the submitted Image was created solely by the entrant, that the Image does not infringe on the copyrights, trademarks, moral rights, rights of privacy/publicity or intellectual property rights of any person or entity, and that no other party has any right, title, claim, or interest in the Image.

In submitting an entry, normal time, toll, connection and usage rates, if any, charged by entrant’s internet service provider will apply. All entries become property of The Ashton-Drake Galleries. By entering the contest, entrants grant Ashton-Drake Galleries the right to display, distribute, reproduce, and create derivative works of the entries, in whole or in part, in any media including, but not limited to advertising and promotion of the Delilah Noir line of dolls on its Web site or in another publication. The Ashton-Drake Galleries will not be required to pay any additional consideration or seek any additional approval in connection with such uses. Entries will be displayed in a gallery on the Delilah Noir site for the duration of the contest. By participating, all entrants agree to abide by and be bound by these Official Contest Rules.

Entry deadline:
All entries must be received by 11:59pm Central Daylight Time (CDT), Saturday, May 1, 2010.

The contest is void where prohibited or restricted by law. Ashton-Drake Galleries reserves the right to cancel the contest or modify these rules at its discretion. The decisions of The Ashton-Drake Galleries are final and binding with respect to all matters related to the Contest.

Winner Selection and Prize Details:
Judging will be conducted by the Ashton-Drake Galleries on or around May 8, 2010. Winning entries will be published on www.DelilahNoir.com. Decisions of the judges will be final.

Three (3) Grand Prize winners will receive $500 each. There is no substitute for the prize. The winners will be notified by email and shall be required to execute an affidavit of eligibility and a release permitting the sponsor to use the winner’s name to promote the Contest. The prize will be awarded within thirty (30) business days after sponsor’s receipt of the signed affidavit/release. If the prize is not claimed within thirty days of notification, a new winner will be selected within five (5) business days after the 30-day period. Odds of winning depend on number of eligible contestants participating during the eligible time period. The value of prize may be taxable as income under applicable federal, state and/or local laws. The prize will be awarded and the winner’s name can be obtained by mailing a request to The Ashton-Drake Galleries, 9200 N. Maryland Ave, ATTN: Delilah Noir Spring Has Sprung Contest, Niles, IL 60714. The decisions of The Ashton-Drake Galleries are final and binding with respect to all matters related to the Contest.

Disclaimers and Releases:
The Ashton-Drake Galleries is not responsible for issues beyond its control. The Ashton-Drake Galleries shall not be liable for 1) failed, returned or misdirected notifications based on inaccurate information provided by the winner on any entry form, 2) entries or responses to winner notifications which are lost, late, incomplete, unintelligible, misdirected, damaged or otherwise not received by the intended recipient due in whole or in part to computer or technical error of any kind, 3) any electronic miscommunications or failures, technical hardware or software failures of any kind, lost or unavailable network connections, or failed incomplete, garbled or delayed computer transmissions which may limit an entrant's ability to participate in the Contest, 4) any technical malfunctions of the telephone network, computer on-line system, computer equipment, software, program malfunctions or other failures, delayed computer transactions or network connections that are human, mechanical or technical in nature, or any combination thereof, including, without limitation, any injury or damage to entrant's or any other person's computer related to or resulting from downloading any part of this Contest or 5) any warranty of fitness or merchantability of the prize or the function thereof, which shall be the sole responsibility of the issuer of the prize. Ashton-Drake Galleries does not make any, and hereby disclaims any and all, representations or warranties of any kind regarding the prize.

By entering, an entrant agrees to release and hold harmless The Ashton-Drake Galleries and its affiliated entities, and their respective directors, officers, employees, attorneys, agents, and representatives from any damage, injury, death, loss, claim, action, demand, or other liability (collectively, “Claims”) that may arise from their acceptance, possession and/or use of the prize or their participation in the Contest, or from any misuse of the prize awarded, regardless of whether such Claims existed at the time of entry or arise at any time thereafter. The Ashton-Drake Galleries reserves the right to modify these Official Contest Rules in any way or at any time. The Ashton-Drake Galleries reserves the right, in their sole discretion, to cancel or suspend this Contest should viruses, bugs or other causes beyond their control corrupt the administration, security or proper play of the Contest. In the event of cancellation or suspension, The Ashton-Drake Galleries shall promptly post a notice on www.DelilahNoir.com to such effect. This Contest shall be governed by Illinois law. By participating in the Contest, entrants agree that Illinois courts shall have jurisdiction over any dispute or litigation arising from or relating to this Contest and that venue shall be only in Chicago, Illinois.
